The trial may threaten to stop the retailer’s operations or impose fines for violation of the technological regulations
According to the materials of the court, Rospotrebnadzor, the Russian consumer protection agency, insists on administrative liability for the Auchan retail chain under Part 3 of Article 14.43 of the Administrative Code of Russia, based on the administrative offence report of 21 August this year.
Taking into account provisions of Part 3 of Article 14.43 of the Administrative Code, this is about a repeated infringement by the manufacturer of technological regulations for the production, storage, transportation, and sale of products that caused damage to life and health of citizens, environment and so on.
If the Moscow Commercial Court rules for Rospotrebnadzor, Auchan may face fines of up to 1 million rubles, or stop operations for up to 3 months, media reported. However, according to experts, courts rarely carry off to a complete company closure, but allow defendants to remedy the breaches with respective fines to be imposed.
